1. Legal Framework & Fundamental Phytosanitary Principles
Before diving into the operational procedures, it is essential to understand how plants are classified under Thai law. This classification directly dictates the complexity and requirements of the import-export process:
Prohibited Articles: Plants that pose a high risk of introducing serious pests—such as the Citrus family, Coconut, and certain economic crops. Importation is strictly forbidden, except for research or experimental purposes, which requires specific authorization from the Director-General of the Department of Agriculture.
Restricted Articles: Plants requiring special control measures. These shipments must be accompanied by a Phytosanitary Certificate and are subject to rigorous pest inspection procedures to ensure they meet entry standards.
Unprohibited Articles: General plants that do not fall into the first two categories. However, do not let the name fool you—their importation must always be accompanied by a Phytosanitary Certificate to verify their health status.
2. Export Procedures
When exporting plants from Thailand to international markets, compliance must primarily align with the regulations of the Destination Country.
Thailand’s Department of Agriculture (DOA) serves as the National Plant Protection Organization (NPPO) responsible for certifying these standards, as detailed below:
Step 1: Verification of Destination Country Requirements
The exporter must verify exactly what documentation is required by the destination country, such as:
Import Permit: The buyer (importer) is responsible for obtaining this document from their local authorities.
Special Declaration (Additional Declaration): Specific certifications required on the certificate, such as declaring the shipment is "Free from Root Knot Nematodes" or "Free from Thrips."
Step 2: Pest-Free Preparation
Plants must be meticulously cleaned and absolutely Soil-Free, as soil is a primary reservoir for bacteria, fungi, and insect eggs. Therefore, most exports are processed in the following formats:
Bare Root: All planting media must be completely washed off, leaving the roots exposed and clean.
Tissue Culture (In Vitro): Plants contained in sterile culture flasks (the method recognized as the highest standard globally).
Step 3: Obtaining the Phytosanitary Certificate
Submit an application (Form P.Q. 7) at the Plant Quarantine Station for official inspection. Officers will conduct a random sampling of the consignment to ensure compliance.
If the shipment is found to be free of pests, the officer will issue the Phytosanitary Certificate, which must be attached to the goods for export.
Step 4: CITES Listed Species
If the plant falls under the CITES convention (e.g., wild orchids, certain species of cacti), an additional CITES Export Permit is mandatory. This permit must be obtained from the Plant Varieties Protection Division in addition to standard export documents.
Step 5: Applying for the Certificate of Origin (CO)
The Certificate of Origin (CO) is an official document issued by a government authority (in Thailand, the Department of Foreign Trade, Ministry of Commerce) to certify that the goods have been produced in strict compliance with the Rules of Origin of the exporting country.
Importance and Types of Certificate of Origin
1. Confirming Product Nationality (Non-Preferential)
Used to verify the country of origin for standard importation without tariff reduction benefits.
It is primarily utilized for import quota controls or compiling international trade statistics.
2. Tax Benefits (Key Factor - Preferential)
This is the document of highest importance in business strategy.
It is submitted to the Customs authority of the destination country to request a "Reduction" or "Exemption" of import tariffs under various Free Trade Agreements (FTAs).
Target Markets Requiring a CO
Utilizing a CO is indispensable in markets that hold Free Trade Agreements (FTAs) with Thailand. It is a strategic move to establish "Price Competitiveness" through tariff mechanisms:
1. People's Republic of China (China)
Document: Form E (ASEAN-China FTA)
Significance: China is a massive market for variegated plants and tissue culture. Form E reduces import tariffs for most plants to 0%, a requirement that Chinese importers prioritize above all else.
2. ASEAN Member States
Document: Form D (ATIGA)
Significance: For exports to Indonesia, Vietnam, the Philippines, or Malaysia, utilizing Form D facilitates smoother customs clearance and grants full tariff exemptions.
3. India
Document: Form FTA (Thai-India FTA) or Form AI (ASEAN-India FTA)
Significance: India maintains very stringent import inspection measures. A valid and accurate CO helps mitigate potential issues regarding cargo quarantine and tax assessments at the port of entry.
4. Japan
Document: Form JTEPA or Form AJCEP
Significance: The Japanese market places extremely high importance on standards and the source of agricultural products. In this context, the CO serves a dual purpose: it grants tax benefits and acts as a guarantee of the quality and origin of Thai goods.
Procedure for Obtaining a CO for Tissue Culture Plants
The process must be conducted through the Department of Foreign Trade (DFT) system, involving the following operational steps:
1. Exporter Registration Those wishing to export must register as a legal entity or individual and enroll in the Exporter Registration database with the DFT. This confirms legal status and grants access to the Electronic Data Interchange (EDI) system.
2. Verification of Origin This is the technically critical step. For Tissue Culture plants, which fall under HS Code 06 (Live Plants)—specifically HS 0602.90 (Other live plants, including roots)—proving origin usually relies on the "Wholly Obtained" (WO) criterion.
Technical Principle: Plants that are cultivated, harvested, or undergo In-vitro culture processes until growth within Thailand are considered 100% Thai Origin.
Supporting Documents: The exporter must submit a request for cost or production process verification, specifying the source of the Mother Plant, chemicals/agar (Media), and laboratory processes for officer approval.
3. Digital Application via EDI Once the origin is verified, the exporter submits details into the EDI system, including:
Exporter and Consignee information.
Transport details.
Description of Goods and HS Code.
Origin Criterion (e.g., specifying code "WO").
4. Approval and Issuance Officers will verify the data against the conditions of the specific trade agreement. Once approved, the exporter can print the form or collect the original document, complete with the official signature and seal, to be sent to the destination country.
3. Import Procedures
Legal Classification & Fundamental Principles
Before proceeding with importation, importers are required to verify the legal status of the specific plant species in accordance with the Notification of the Ministry of Agriculture and Cooperatives. Thai law categorizes plants into three main types, each with distinct import requirements:
1. Prohibited Articles Refers to plants, agricultural materials, or carriers that pose a high risk of spreading serious pests (e.g., Thailand's major economic crops such as Coconut, Rubber, Coffee, Oil Palm, etc.).
Condition: Commercial importation is strictly prohibited.
Exception: Importation is permitted solely for academic research or experimentation. This requires explicit authorization from the Director-General of the Department of Agriculture and strict adherence to quarantine conditions.
2. Restricted Articles Refers to plants with a moderate risk level that require control measures to prevent specific pests.
Condition: Importers must obtain an Import Permit in advance from the Department of Agriculture. Additionally, the shipment must undergo phytosanitary certification from the country of origin.
3. Unprohibited Articles Refers to general plants that are not listed in the Prohibited or Restricted categories.
Condition: An advance import permit is not required. However, the shipment must be accompanied by a Phytosanitary Certificate at all times to confirm its disease-free status.
Additional Precaution: It is mandatory to verify the Appendices of the CITES Convention (Convention on International Trade in Endangered Species of Wild Fauna and Flora) to determine if the specific plant is a protected species.
If listed, the shipment must be accompanied by a valid CITES Permit in addition to standard import documents.
Import Process & Procedures
Once the plant classification is determined, the operational steps for importation are as follows:
1. Pre-Importation Licensing If the item is classified as a "Prohibited" or "Restricted" article, the importer must submit an application (Form P.Q. 5) to the Plant Quarantine Station or the Office of Agricultural Regulation to obtain an official Import Permit.
2. Documentation from Origin The exporter must obtain a Phytosanitary Certificate (PC) from the National Plant Protection Organization (NPPO) of the exporting country. This document must certify the correct Scientific Name and confirm that the plants are free from pests and soil.
3. Growing Media Requirements Under Thai law, the importation of soil or planting media containing organic matter susceptible to contamination is strictly prohibited. Plants must be imported in the following forms:
Bare Root: Roots must be meticulously washed and completely free of soil.
In Vitro: Tissue culture plants in sterile glass flasks (Sterile condition).
Sterile Synthetic Media: Planting materials that have undergone sterilization according to prescribed standards.
4. Inspection at Port of Entry Upon arrival at the airport or border checkpoint, the Plant Quarantine Officer will verify documentation and conduct random cargo inspections. If pests, soil, or false declarations are found, the officer has the authority to order the immediate destruction or re-export of the shipment.
